Acceptance of Terms
By accessing the Battle Plan Marketing website (the "Site"), or by purchasing or using any of our productized services (the "Services"), you agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and any additional terms specific to the service you've purchased.
"We," "us," and "Battle Plan Marketing" refer to Battle Plan Marketing, LLC, a California limited liability company located at 30141 Antelope Rd, Ste D-438, Menifee, CA 92584. "You" and "Customer" refer to the individual or business entity using the Services.
If you do not agree to these Terms, do not use the Site or the Services.
Services Offered
Battle Plan Marketing currently offers five productized services. Appointment Accelerator™, AssociatePro™, and RapidReviews™ are flat monthly subscriptions billed in advance with no long-term contract. The $99 Website Plan is billed annually in advance for a twelve-month service term. The Customer Reactivation Campaign is a one-time, project-based service billed as a setup fee (see Section 5 for billing details).
Appointment Accelerator™
A done-for-you lead-capture, AI-follow-up, and automated-booking system for local service businesses. We install speed-to-lead messaging, AI-driven nurturing sequences, calendar integration, and appointment reminders inside GoHighLevel.
AssociatePro™
A done-for-you AI sales-associate system for e-commerce stores. We install on-site AI chat that answers product questions, recovers abandoned carts via SMS and email, books calls when escalation is needed, and connects to your store, CRM, and analytics.
RapidReviews™
A done-for-you automated review-generation and reputation-management system. We install QR-code triggers, SMS and email review-request flows, a custom NPS gate, on-brand AI auto-replies, a real-time website review embed, and social auto-posting.
$99 Website Plan
A done-for-you, fixed-scope website service for service businesses. The plan delivers seven (7) pages — home, services, about, contact, calendar, terms of service, and privacy policy — built on one of our approved designs, applied to your business name, services, contact information, and one (1) owner or team photograph. The site is hosted exclusively on Battle Plan Marketing's Hostinger account; client-side hosting is not permitted under the plan. Optional add-ons include additional pages at $295 each (one-time), domain registration at $19.99 per year (pass-through pricing, no markup), and a one-time $2,000 code buyout that ends the subscription and transfers source files. Billed annually at $1,188 per year (equivalent to $99 per month). A monthly billing option at $149 per month is available case-by-case at Battle Plan Marketing's discretion.
Customer Reactivation Campaign
A done-for-you, automated, sequenced offer campaign sent to the client's existing customer database to generate immediate sales revenue. The engagement includes list cleaning and verification, a campaign landing page, an offer form, offer-delivery systems, branded SMS and email systems to send the offers, automated appointment scheduling integrated with Battle Plan Marketing's CRM or (in most cases) the client's CRM, and an AI booking agent for hands-off communications. The client must provide their customer database as a CSV file that includes, at minimum, each customer's name and phone number; email addresses are optional but improve results. Billed as a one-time $995 setup fee, with future edits or additional campaigns at a one-time $695 each. See Section 3 for the performance guarantee and Section 5 for billing details.
Additional services, add-ons, and one-time professional engagements may be offered separately and governed by their own engagement-specific terms (for example, postcard design, print, and shipment for RapidReviews™).
Service Guarantees & Refunds
Battle Plan Marketing offers different guarantee terms for each productized service. Eligibility, the refund window, and what's covered are listed below.
Appointment Accelerator™ — 45-Day Money-Back Guarantee
If, within forty-five (45) days of your initial subscription payment for Appointment Accelerator™, the service is not delivering the technical functionality described in Section 4 (speed-to-lead automation, AI follow-up, automated booking, appointment reminders), you may cancel and receive a full refund of your most recent subscription payment.
AssociatePro™ — 30-Day Money-Back Guarantee
If, within thirty (30) days of your initial subscription payment for AssociatePro™, the service is not delivering the technical functionality described in Section 4 (on-site AI sales associate, cart recovery, escalation logic, store and CRM integration), you may cancel and receive a full refund of your most recent subscription payment.
Customer Reactivation Campaign — Double-Your-Investment Guarantee
The Customer Reactivation Campaign is guaranteed to generate attributable gross sales of at least two times (2×) the campaign cost within sixty (60) days of the campaign going live. If it does not, you may request cancellation and Battle Plan Marketing will shut the campaign down and refund your full payment for that campaign.
Attributable gross sales are measured by the appointments booked through the Battle Plan Marketing campaign or an integrated CRM, applied to the client's own performance figures:
Appointments Booked × Avg. Show Rate × Avg. Close Rate × Avg. Sale Value = Attributable Gross Sales
The client's average show rate, average close rate, and average sale value are collected from the client prior to campaign build and are used for this calculation. Example: for a $995 campaign, Appointments Booked × Show Rate × Close Rate × Avg. Sale must total at least approximately $2,000 (2× the campaign cost) within 60 days.
This guarantee requires that you supply a usable, permission-based customer database — provided as a CSV file that includes, at minimum, each customer's name and phone number (email addresses are optional but improve results) — and that you reasonably honor and fulfill offers redeemed by reactivated customers.
RapidReviews™ — No Money-Back Guarantee
RapidReviews™ is sold without any money-back guarantee. No refunds are issued for any reason once a subscription payment has been processed, including but not limited to: dissatisfaction with results, lower-than-expected review volume, technical issues with third-party platforms, accidental purchase, or change of mind.
RapidReviews™ remains month-to-month with no contract. You may cancel at any time and your service will continue through the end of the current billing period, after which no further charges will be made. No prorated or partial refunds are issued upon cancellation.
By subscribing to RapidReviews™, you acknowledge and accept that this service is sold on a final-sale basis once payment is processed.
$99 Website Plan — No Money-Back Guarantee & No Refunds
The $99 Website Plan is sold without any money-back guarantee. The plan is billed annually in advance at $1,188 for a twelve-month service term, and no refunds — full, prorated, or partial — are issued at any point during that term for any reason, including but not limited to: dissatisfaction with the selected design, change of mind, business closure or change of ownership, failure to provide content or required materials, decision to switch hosting providers, request to change the design or layout outside the plan's fixed scope, or cancellation prior to the end of the twelve-month term.
A monthly billing option at $149 per month (where extended by Battle Plan Marketing at its discretion) is similarly final-sale once each monthly payment is processed. No refunds are issued for the most recently billed month upon cancellation.
Cancellation behavior. You may notify Battle Plan Marketing of cancellation at any time by writing to office@mg.battleplan-marketing.com. Cancellation takes effect at the end of the current paid period (annual or monthly, as applicable). Upon cancellation, the website is taken offline and access ends — the $99 Website Plan is a hosted service, and continued site availability requires continued payment.
Source code is not transferred by virtue of subscription payment. If the client wishes to retain the website files and host them elsewhere, the optional code buyout add-on ($2,000 one-time) must be purchased separately. Upon receipt of the buyout payment, source files are delivered to the client and the subscription terminates with no further fees from either party.
By subscribing to the $99 Website Plan, you acknowledge and accept that this service is sold on a final-sale basis, that the twelve-month term is non-refundable once payment is processed, and that the website remains property of Battle Plan Marketing for purposes of hosting and operation unless the code buyout has been completed.
How to request a refund (Appointment Accelerator™ or AssociatePro™ only)
To claim a refund under an applicable guarantee, you must complete the following steps within the relevant guarantee window:
- Cancel the service in writing by emailing office@mg.battleplan-marketing.com with the subject line "Guarantee Refund Request" and the name of the service you are canceling.
- We will acknowledge receipt within one (1) business day and confirm the cancellation.
- We will shut down your service immediately upon cancellation — including any automations, AI replies, scheduled messages, and active integrations tied to that service.
- We will refund the most recent subscription payment for the canceled service in full, processed within five (5) to ten (10) business days to your original method of payment.
What's not covered under any guarantee
The following are excluded from all refunds, regardless of service or guarantee window:
- Pass-through messaging costs already incurred — including SMS, MMS, voice-call, and email charges (see Section 6).
- Paid add-ons that have already been delivered, including but not limited to custom postcard design, print, and shipment.
- Third-party fees charged directly by Google, Meta, Twilio, Mailgun, LeadConnector/GoHighLevel, or any other vendor not controlled by Battle Plan Marketing.
- Subscription payments older than the relevant guarantee window for the canceled service (older than 45 days for Appointment Accelerator™, older than 30 days for AssociatePro™).
- Cancellations of RapidReviews™ subscriptions at any time.
- Cancellations after the applicable guarantee window on AppAccel or AssociatePro are still permitted at any time, but no refund is issued for the most recently billed period — see Section 5.
Each applicable guarantee is offered once per service per customer. If you cancel and refund under a guarantee and later re-subscribe to the same service, that subsequent subscription is not eligible for another refund.
Per-Service Deliverables & Limitations
The refund mechanisms in Section 3 are tied to the service deliverables described below. These are the technical deliverables we commit to installing, running, and operating within each service's applicable guarantee window (where one exists).
What we guarantee (within 45 days)
- Speed-to-lead automation responding to inbound leads via SMS and email within minutes of submission.
- AI-driven follow-up sequence running through your CRM (GoHighLevel by default).
- Automated booking flow connected to your calendar of choice.
- Appointment reminders sent at industry-standard intervals (24h, 1h, 15min) before scheduled bookings.
- Onboarding completion and live system handover within fourteen (14) business days of project start.
What we do not guarantee
- Lead volume. We do not generate leads — we capture and convert the leads your marketing produces. Lead volume depends on your own paid traffic, SEO, and offline channels.
- Conversion outcomes. We do not guarantee a specific number of booked appointments, closed sales, or revenue lift. Conversion depends on your offer, market, pricing, sales process, and team execution.
- Third-party integration uptime. Our system depends on GoHighLevel, Twilio, Mailgun, and your CRM/calendar of choice. Outages or policy changes by those platforms are outside our control.
What we guarantee (within 30 days)
- On-site AI sales-associate widget installed on your e-commerce store and trained on your product catalog and brand voice.
- Abandoned-cart recovery flow via SMS and email.
- Escalation logic that books calls or hands conversations to a live representative when the AI cannot resolve a customer question.
- Integration with your store platform (Shopify, WooCommerce, or equivalent supported platform) and your CRM.
- Onboarding completion and live system handover within fourteen (14) business days of project start.
What we do not guarantee
- Ad-traffic volume or quality. AssociatePro™ converts the traffic you bring. We do not run, manage, or guarantee the performance of your paid ads.
- Specific conversion-rate or revenue outcomes. Performance depends on your products, pricing, offers, ad creative, and audience match.
- Third-party platform behavior. Changes by Shopify, WooCommerce, payment processors, or other vendors that affect chat widget delivery are outside our control.
RapidReviews™ is sold without any money-back guarantee. The deliverables below describe what the subscription includes, but they do not create a refund right. By subscribing, you accept that this service is final-sale once payment is processed. See Section 3 for the full no-refund policy.
What the subscription includes
- Custom QR code, NPS gate, and trigger flows installed and active.
- Automated SMS and email review-request sequences with one-day follow-up if the first request goes unclicked.
- On-brand AI auto-replies posted to public reviews, typically within one (1) hour of the review going live.
- Website review-embed code generated and supplied for installation on your site.
- Social auto-posting of 4-star-and-higher reviews to your connected channels (Facebook, Google Business Profile, Instagram, LinkedIn).
- Onboarding completion and live system handover within ten (10) business days of project start.
What we do not promise
- A specific number of reviews. Review volume depends on your customer flow, customer satisfaction, and how actively you deploy the QR codes and triggers we install.
- Star-rating outcomes. We cannot promise an average rating because the rating reflects real customer experience with your business.
- Local search rank movement directly attributable to RapidReviews™ alone. Local SEO depends on many factors outside any single tool's control.
- Review-platform policy changes. Google, Facebook, Yelp, Angi, and other platforms may change their rules around review solicitation, embed display, and reply behavior. We adjust to remain compliant, but we cannot prevent platform-side changes.
- Postcard delivery, print quality, or shipment. Physical postcard production is a paid add-on, not part of the monthly subscription, and is governed by separate engagement terms.
The $99 Website Plan is sold without any money-back guarantee. The deliverables below describe what the annual subscription includes, but they do not create a refund right. By subscribing, you accept that this service is final-sale once payment is processed and the twelve-month term is non-refundable in whole or in part. See Section 3 for the full no-refund policy.
What the subscription includes
- Seven (7) pages built and published on one of our approved designs: home, services (all services listed on a single page), about (with one owner or team photo), contact, calendar (a bookable scheduling page), terms of service, and privacy policy.
- Business-identity content drop-in: business name, contact information, hours, service area, services list, and one (1) owner or team image on the About page.
- Logo and brand color matching applied throughout the site — provided the client supplies the exact HEX color codes. Color matching by JPG, screenshot, or visual approximation is not supported under the plan.
- Hosting on Battle Plan Marketing's Hostinger account for the duration of the active subscription — including SSL, daily backups, and uptime monitoring.
- Domain pointing at no additional cost when the client already owns a domain through any registrar (GoDaddy, Namecheap, Google Domains, or equivalent).
- Ongoing business-info updates covered by the monthly plan: business name, contact info, hours, service area, and services list. Other changes are out of scope (see below).
- Launch within seven (7) business days of receipt of all required client materials (selected design, business info, services list, owner or team photograph, and HEX codes if applicable).
What the plan does NOT include
- Font changes of any kind. Fonts are fixed as part of the original design.
- Design or layout edits outside the original approved design. Page structure, section ordering, component design, and visual hierarchy are fixed.
- Additional images beyond the single owner or team photograph on the About page. Other images on the site are part of the original design and are not swapped, replaced, or supplemented under the plan.
- Text or image edits beyond the business-identity drop-in described above. The plan does not cover ongoing copywriting, blog content, image sourcing, or design iteration.
- Hosting on any account other than Battle Plan Marketing's Hostinger account. Client-side hosting, multi-host arrangements, and migrations to client-controlled infrastructure are not permitted under the subscription. The only path to client-side hosting is the optional $2,000 code buyout described in Section 3.
- Domain registration as part of the monthly fee. Clients who do not already own a domain may register one through Battle Plan Marketing at $19.99 per year (pass-through Hostinger cost, no markup). Domain ownership and renewal remain the client's responsibility.
- Additional pages beyond the seven (7) included. Additional pages are available at $295 each (one-time charge per page) and become part of the active subscription with no additional recurring hosting fee.
- Active SEO services, paid-ad management, conversion optimization, or marketing services. The $99 Website Plan delivers a hosted website. Lead generation, traffic capture, and conversion services are sold separately under Appointment Accelerator™ or other engagements.
- Lead, traffic, or conversion outcomes. The plan delivers a published website; it does not promise inbound leads, search ranking improvements, or revenue results.
- Source code transfer. Source files remain Battle Plan Marketing property unless the optional $2,000 code buyout is purchased separately. On cancellation without buyout, the site is taken offline and no files are transferred.
Subscription & Billing
5.1 Billing cycle
Monthly services. Appointment Accelerator™, AssociatePro™, and RapidReviews™ are billed as flat monthly subscriptions, in advance, on the same day each calendar month following your initial subscription date.
Annual service. The $99 Website Plan is billed annually, in advance, at $1,188 for a twelve (12) month service term. Renewal is automatic at the end of the term unless cancelled in writing prior to the renewal date. A monthly billing option at $149 per month may be extended at Battle Plan Marketing's discretion; where extended, the monthly option is processed in advance on the same day each calendar month.
Payment is processed via the method you provided at signup.
5.2 Contract length
Appointment Accelerator™, AssociatePro™, and RapidReviews™ are month-to-month with no long-term contract. You may cancel at any time. There is no termination fee.
The $99 Website Plan is a twelve (12) month service term when billed annually. Cancellation prior to the end of the twelve-month term is permitted but does not entitle the client to a refund, prorated or otherwise — see Section 3. The monthly billing option (where extended) is month-to-month; cancellation takes effect at the end of the current paid month with no refund of the most recently billed month.
5.3 Cancellation outside the applicable guarantee window
If you cancel after the applicable guarantee window — or at any time for RapidReviews™ and the $99 Website Plan (which have no guarantee window) — the cancellation takes effect at the end of your current billing period (monthly for AppAccel, AssociatePro, RapidReviews, or the monthly variant of the $99 Plan; the end of the twelve-month term for the annual $99 Plan). You retain access to the service through the end of the period you've already paid for. No refund is issued for that period.
For the $99 Website Plan specifically, cancellation results in the website being taken offline at the end of the paid period. No site files are transferred to the client unless the optional $2,000 code buyout is purchased separately (see Section 3).
To cancel, email office@mg.battleplan-marketing.com with the subject line "Cancellation Request" and the name of the service.
5.4 Promotional and discount codes
From time to time we offer promotional discount codes (for example, GROWMYREVIEWS). When a code includes a "for life" or "locked-in" rate, the discounted price will apply to your subscription for as long as you maintain continuous, uninterrupted billing. Discounts do not survive cancellation: if you cancel and re-subscribe later, the discount is no longer valid.
5.5 Price changes
We may adjust standard subscription pricing for new customers at any time. Existing subscribers on a locked-in promotional rate are protected from these changes as long as their subscription remains active and continuous, in accordance with the terms of that specific promotion. For the $99 Website Plan, the annual rate at signup applies for the active twelve-month term; renewal rates may differ and will be communicated at least thirty (30) days prior to renewal.
5.6 Failed payments
If a scheduled payment fails, we will retry the charge and notify you by email. If payment is not successfully made within seven (7) days of the original billing date, the service may be paused or terminated. For the $99 Website Plan, failed annual renewal payment will result in the website being taken offline at the end of the existing paid term. Pass-through messaging costs continue to apply to any messages already sent during the period.
5.7 $99 Website Plan — additional billing rules
One-time charges. The $99 Website Plan supports two one-time charges that sit alongside the annual subscription: additional pages at $295 each (a one-time fee per page added) and the code buyout at $2,000 (a one-time fee that transfers source files and ends the subscription). One-time charges are non-refundable once the corresponding deliverable is provided (page published or source files delivered).
Pass-through charges. Domain registration at $19.99 per year is a pass-through Hostinger registration cost. It is billed annually and is non-refundable once registered. Renewal is automatic and continues for as long as the underlying subscription is active.
No partial refunds for early cancellation. If the client cancels the $99 Website Plan at any point during the twelve-month term, no portion of the annual fee is refunded. The website remains live through the end of the paid term.
No transfer of code or domain on cancellation. On cancellation without buyout, source files are not transferred to the client. Domains registered through Battle Plan Marketing remain registered in the client's name (the client owns the domain) and may be transferred to another registrar at the client's request and expense. Domains the client originally provided to Battle Plan Marketing for hosting remain the client's property at all times.
5.8 Automatic-Renewal Terms (California Residents & All Subscribers)
This subsection summarizes our automatic-renewal practices in compliance with the California Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600–17606) and applies to all subscribers regardless of state of residence.
(a) Automatic renewal. All Battle Plan Marketing subscriptions renew automatically at the end of each billing period using the payment method on file. The $99 Website Plan renews annually on the anniversary of your subscription start date at the then-current annual rate, unless cancelled before the renewal date. Appointment Accelerator™, AssociatePro™, and RapidReviews™ renew monthly on the same day of each calendar month at the then-current monthly rate, unless cancelled before the renewal date.
(b) Affirmative consent at signup. Before your first subscription payment is processed, you will be presented with a clear and conspicuous disclosure of the auto-renewal terms (renewal frequency, renewal price, cancellation method, and contact information for cancellations) and asked to provide affirmative consent via a separate checkbox. Your subscription will not begin until you provide that affirmative consent.
(c) Post-purchase acknowledgment. Following your initial subscription payment, you will receive an acknowledgment email from office@mg.battleplan-marketing.com that includes (i) the auto-renewal terms, (ii) the cancellation policy, (iii) instructions for how to cancel, and (iv) the contact information for cancellation requests. You may retain this acknowledgment for your records.
(d) Reminder notice for annual subscriptions. For the $99 Website Plan (which is an annual subscription), Battle Plan Marketing will send a reminder email to the address on file between fifteen (15) and forty-five (45) days before each annual renewal date. The reminder will include the upcoming renewal date, the renewal amount, instructions for how to cancel, and a direct link to the online cancellation method.
(e) Easy online cancellation. If you subscribed online, you may cancel online without speaking to a representative or sending a written request. Online cancellation is available through your account portal at app.battleplan-marketing.com (look for "Cancel Subscription" inside Account > Billing). You may also cancel by emailing office@mg.battleplan-marketing.com with the subject line "Cancellation Request" or by calling 1.951.470.1950 during business hours. Online cancellation is at least as easy to use as the method by which you subscribed.
(f) Effect of cancellation. Cancellation takes effect at the end of the current paid billing period (the next monthly anniversary for monthly subscriptions, or the end of the twelve-month term for the annual $99 Website Plan). You retain access to the service through the end of the paid period. No refund (full, prorated, or partial) is issued for the current period upon cancellation, except as expressly provided in the guarantee windows in Section 3.
(g) Free trial or promotional pricing. If your subscription begins with a free trial or promotional/introductory price, Battle Plan Marketing will provide a separate disclosure of the post-trial or post-promotion renewal price and obtain renewed affirmative consent before charging the higher rate. You may cancel during any free trial or promotional period using the methods described in subsection (e) above to avoid being charged.
(h) Material changes to renewal terms. If Battle Plan Marketing materially changes the auto-renewal terms of an active subscription (renewal frequency, renewal price beyond standard inflation adjustments, or cancellation method), affected subscribers will be notified by email at least thirty (30) days before the change takes effect. You may cancel before the change takes effect using the methods in subsection (e).
Pass-Through Messaging Costs
Battle Plan Marketing services rely on underlying communications infrastructure provided by LeadConnector / GoHighLevel and its upstream vendors (including but not limited to Twilio for SMS, MMS, and voice, and Mailgun for email). Standard, published rates for those services apply to all messages sent or received through your subscription. These are pass-through costs, not Battle Plan Marketing fees.
Pass-through costs typically include
- SMS — per-segment fee for each outbound or inbound text (a segment is up to 160 characters; longer messages bill as multiple segments).
- MMS — per-message fee for messages containing images or media; rates are higher than SMS.
- Voice calls — per-minute fee for outbound and inbound calls placed or received by the system.
- Email — per-email fee for outbound emails sent through the platform.
- Phone number rental — a monthly fee per provisioned phone number used for SMS or voice.
- A2P 10DLC registration — one-time and monthly fees for U.S. business-text-messaging compliance.
- Country-specific carrier fees — vary by destination country.
Rates are set by the underlying vendor and change from time to time. For current pricing, refer to LeadConnector's published rate guide: Calculating SMS and MMS Costs — LeadConnector.
You are responsible for maintaining a positive balance and active billing method inside your LeadConnector / GoHighLevel account. If your messaging balance is exhausted, automated messaging through the system will pause until the balance is restored. Battle Plan Marketing is not responsible for missed customer communications, lost leads, or reputational impact arising from a depleted messaging balance.
Pass-through costs are not refundable under the 30-day money-back guarantee in Section 3, because those costs are paid to underlying carriers and consumed at the moment a message is sent.
SMS Messaging Terms & Compliance
7.1 Program description
This messaging program sends appointment confirmation and reminder messages to customers who have booked an appointment with Battle Plan Marketing, LLC through our website at battleplan-marketing.com, or via our scheduling forms, and have explicitly opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox for SMS consent. Messages include scheduling confirmations, appointment reminders, rescheduling updates, and customer support communications.
7.2 Cancellation instructions
You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
7.3 Support information

7.4 Carrier liability
Carriers are not liable for delayed or undelivered messages.
7.5 Message & data rates
Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.
7.6 Supported carriers
Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers.
7.7 Age restriction
You must be 18 years or older to participate in our SMS program.

7.9 Regulatory compliance
We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications.
Intellectual Property
All content on the Battle Plan Marketing website — including but not limited to text, graphics, logos, audio, video, software, brand names, service marks, and the productized service names Appointment Accelerator™, AssociatePro™, and RapidReviews™ — is the property of Battle Plan Marketing, LLC and is protected by U.S. and international intellectual-property law.
You may not copy, reproduce, modify, distribute, publish, or create derivative works from any of our marketing materials, brand assets, or proprietary systems without our prior written consent.
Customer-supplied content (your logos, copy, customer data, product information, etc.) remains your property. You grant us a limited, non-exclusive license to use that content solely for the purpose of delivering the Services you've subscribed to.
Upon cancellation, we will export or hand over customer-owned data on reasonable request, subject to the data and privacy provisions in Section 10 and our Privacy Policy.
Acceptable Use
You agree not to use the Services to:
- Send unsolicited commercial messages (SPAM) in violation of the CAN-SPAM Act, TCPA, or any applicable U.S. or international communications law.
- Solicit, fabricate, or incentivize fake reviews in violation of Google, Facebook, Yelp, Angi, or any other review-platform terms of service.
- Send messages to recipients who have not consented to receive them, or who have requested to opt out.
- Use the Services for any unlawful, fraudulent, harassing, or abusive purpose.
- Impersonate any person, business, or entity, or misrepresent your affiliation with Battle Plan Marketing.
- Attempt to reverse-engineer, copy, or replicate our proprietary automations, templates, or AI prompts for resale or competing service.
We reserve the right to suspend or terminate Services without refund if you violate this Acceptable Use policy. Suspension or termination under this section does not entitle you to a refund under the 30-day guarantee.
Data & Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, store, and use personal data — both yours as a customer and your end-customers' data flowing through the system.
You are responsible for ensuring that your collection and use of end-customer data through the Services complies with applicable privacy law, including the California Consumer Privacy Act (CCPA/CPRA), the EU General Data Protection Regulation (GDPR) where applicable, and any other regulation governing your jurisdiction and your customers' jurisdictions.
Battle Plan Marketing acts as a service provider/processor of the end-customer data flowing through your subscription. We will not sell or use your end-customer data for our own commercial purposes outside of providing the Service.
Disclaimers & Limitation of Liability
11.1 No guarantee of business outcomes
While we guarantee that the Services will be installed, operating, and delivering the technical functionality described in Section 4, we make no guarantee of business outcomes. This includes, but is not limited to: lead volume, booked appointments, closed sales, revenue, profit, conversion rate, search ranking, review count, or star rating. These outcomes depend on factors outside our exclusive control, including your offer, market, pricing, sales execution, ad performance, and customer experience.
11.2 "As is" basis
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, except as explicitly stated in these Terms. We disclaim all implied warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.3 Limitation of liability
To the maximum extent permitted by law, Battle Plan Marketing's total cumulative liability arising out of or relating to these Terms or the Services — regardless of the form of action (contract, tort, statute, or otherwise) — will not exceed the amount you paid us in subscription fees during the three (3) months immediately preceding the event giving rise to the claim.
In no event will Battle Plan Marketing be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to lost profits, lost revenue, lost data, business interruption, or reputational harm — even if we have been advised of the possibility of such damages.
11.4 Indemnification
You agree to defend, indemnify, and hold harmless Battle Plan Marketing, LLC and its officers, employees, and contractors from any claim, demand, loss, or damage arising out of: (a) your use of the Services, (b) your violation of these Terms or any applicable law, (c) your customer content or end-customer data, or (d) your breach of any third-party platform's terms of service while using our Services.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Riverside County, California, and you consent to the personal jurisdiction of those courts.
Before initiating any formal legal action, both parties agree to first attempt in good faith to resolve the dispute through direct communication for at least thirty (30) days. If the dispute cannot be resolved through good-faith communication, either party may proceed to court.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, notify active subscribers by email at least fifteen (15) days before the changes take effect.
Continued use of the Services after the effective date of a change constitutes acceptance of the updated Terms. If you do not agree to a change, your remedy is to cancel the affected service before the change takes effect.
California Resident Disclosures
14.1 California Consumer Privacy Act (CCPA/CPRA) — Your Rights
If you are a California resident, the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the "CCPA"), provides you with the following rights with respect to personal information that Battle Plan Marketing collects about you:
- Right to know. You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the sources from which we collected it, the business or commercial purpose for collecting it, the categories of third parties with whom we share it, and the specific pieces of personal information we have collected about you.
- Right to delete. You have the right to request that we delete personal information we have collected from you, subject to certain exceptions (for example, where retention is required to complete a transaction, detect security incidents, comply with a legal obligation, or for other internal uses compatible with the context in which you provided the information).
- Right to correct. You have the right to request that we correct inaccurate personal information we maintain about you.
- Right to opt out of sale or sharing. Battle Plan Marketing does not sell personal information for monetary consideration, and we do not "share" personal information for cross-context behavioral advertising as those terms are defined under the CCPA. If our practices change, we will update this notice and provide a "Do Not Sell or Share My Personal Information" link as required.
- Right to limit use of sensitive personal information. Battle Plan Marketing does not use or disclose sensitive personal information for any purpose beyond what is necessary to provide the Services you've requested.
- Right to non-discrimination. We will not discriminate against you for exercising any of your CCPA rights. We will not deny you services, charge you a different price, or provide a different level of service because you exercised your rights.
How to exercise your CCPA rights: Submit a request by email to office@mg.battleplan-marketing.com with the subject line "California Privacy Request" or by calling 1.951.470.1950 during business hours. We will verify your identity before fulfilling the request and respond within forty-five (45) days as required by the CCPA. You may also designate an authorized agent to make a request on your behalf, provided the agent supplies written authorization and we are able to verify the agent's identity. See our Privacy Policy for additional detail on what categories of personal information we collect and how we use it.
14.2 California "Shine the Light" Disclosure
California Civil Code § 1798.83 (the "Shine the Light" law) permits California residents to request, once per calendar year, certain information about Battle Plan Marketing's disclosure of personal information to third parties for those third parties' direct marketing purposes during the immediately preceding calendar year. Battle Plan Marketing does not currently share personal information with third parties for those third parties' own direct marketing purposes. To request the Shine the Light disclosure or to confirm our current practice, email office@mg.battleplan-marketing.com with the subject line "Shine the Light Request."
14.3 California Consumer Complaint Notice (Cal. Civ. Code § 1789.3)

14.4 California Automatic Renewal Law
The auto-renewal terms applicable to California residents (and all subscribers) are set forth in Section 5.8 above. Those terms reflect Battle Plan Marketing's compliance with the California Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600–17606), including pre-purchase disclosure, affirmative consent, post-purchase acknowledgment, reminder notice for annual subscriptions, and easy online cancellation.
Affiliate & Referral Partner Program
15.1 The Program & Enrollment
The Battle Plan Marketing Referral Partner Program (the "Program") allows approved individuals and businesses ("Partner," "you") to earn commissions for referring new paying clients to Battle Plan Marketing, LLC ("we," "us"). To participate, you must complete our enrollment form and be accepted into the Program. We may approve or decline any applicant, and suspend or remove any Partner, at our sole discretion.
You must be at least 18 years old, legally able to enter into a contract, and provide accurate enrollment, payment, and tax information. Your acceptance into the Program, together with these Terms, forms a binding agreement. Joining the Program is free. The Program is not a business opportunity, franchise, security, or investment offering, and no purchase or fee is required to enroll.
15.2 Commission Structure
Subject to the conditions below, we pay Partners a flat 30% recurring commission on the subscription revenue we actually collect from active client accounts the Partner refers. There are no tiers and no caps on the number of accounts a Partner may refer.
- When it starts. Commission begins after the referred client's money-back guarantee period has elapsed and the account remains active and paid in full.
- How long it lasts. Commission continues for each billing cycle the referred account remains active and in good standing.
- What it's calculated on. Commission is 30% of the net subscription fees actually collected for the applicable Service — excluding taxes, third-party or pass-through messaging costs (see Section 6), discounts, credits, and any amounts later refunded or charged back.
For one-time or project-based services such as the Customer Reactivation Campaign, commission is 30% of the one-time fee actually collected and is paid once per charge rather than on a recurring basis.
15.3 Referral Attribution
A "referred client" is a new client who is not already a customer or active lead in our system and whose account is attributed to you through your unique referral link or code, or whom we otherwise identify in good faith as having been referred by you at the time of sale. We determine attribution in our reasonable discretion; where more than one Partner claims the same client, our determination is final. Self-referrals — referring your own business or accounts you control — are not eligible unless approved by us in writing in advance.
15.4 Payment Terms
- Commissions are paid every 30 days on active, eligible accounts that are past the money-back guarantee period, using the payment method designated in your partner portal.
- You are responsible for providing valid payment and tax information (including an IRS Form W-9 for U.S. Partners). We may withhold payment until complete, accurate information is on file.
- A minimum payout threshold may apply as stated in your partner portal; balances below the threshold roll forward to the next payout cycle.
- Chargebacks, refunds & reversals. If a referred client cancels, refunds, or charges back in a manner that reverses revenue, the corresponding commission is reversed and may be deducted from current or future payouts. Commissions paid in error may likewise be recovered.
- You are solely responsible for all taxes on commissions you earn. We will issue an IRS Form 1099 where required by law.
15.5 Independent Contractor Status
You participate in the Program as an independent contractor. Nothing in these Terms creates an employment, agency, partnership, joint-venture, or franchise relationship between you and Battle Plan Marketing. You have no authority to bind us, to make representations, guarantees, or commitments on our behalf beyond the approved materials we provide, to set or negotiate pricing, or to enter agreements for us. You are responsible for the manner and means of your own promotional activities and for all costs you incur.
15.6 Disclosure & Truthful Advertising (FTC)
You must comply with the Federal Trade Commission Act and the FTC's Guides Concerning the Use of Endorsements and Testimonials in Advertising (16 C.F.R. Part 255). In particular:
- Disclose your connection. In every post, message, email, video, or other promotion, you must clearly and conspicuously disclose that you earn a commission or have a material connection to Battle Plan Marketing (for example, "affiliate," "#ad," or "I earn a commission if you sign up").
- No false or misleading claims. You may not make any false, misleading, deceptive, or unsubstantiated claim about us, our Services, results, guarantees, or potential earnings. Use only the claims, statistics, and figures we provide or approve. Outcomes and income are not guaranteed.
15.7 Anti-Spam & Communications Compliance
- Email. All email promotion must comply with the CAN-SPAM Act — no false or misleading headers or subject lines, a valid physical postal address, identification of the message as an advertisement where required, and a working unsubscribe mechanism that is honored promptly.
- Calls & texts. Any phone or SMS outreach must comply with the Telephone Consumer Protection Act (TCPA) and applicable state laws, including obtaining any required prior consent.
- No spam. You may not send unsolicited bulk email or messages, purchase or scrape contact lists, or use any deceptive or unlawful distribution method.
15.8 Prohibited Promotional Conduct
You may not:
- Bid on, or use in paid search or domain names, "Battle Plan Marketing," our trademarks, or terms confusingly similar to them; or run paid ads that imply you are us or an official representative.
- Engage in cookie stuffing, forced clicks, fake, incentivized, or fraudulent sign-ups, or any attempt to manipulate referral tracking.
- Represent yourself as Battle Plan Marketing or an employee, or create websites, profiles, or accounts that imply you are us.
- Offer unauthorized coupons, rebates, discounts, or pricing in our name.
- Promote us on any site or channel containing illegal, infringing, deceptive, hateful, adult, or otherwise objectionable content.
- Violate the rules of any platform you use (for example, LinkedIn, Meta, Google) or any applicable law or regulation.
15.9 Marketing Materials & Trademark License
We grant you a limited, non-exclusive, revocable, non-transferable license to use the marketing materials and trademarks we provide, solely to promote the Services in accordance with these Terms and our brand guidelines. You may not alter our logos or marks without permission, and you may not register our marks or any confusingly similar marks or domains. All goodwill from your use inures to us. We may revoke this license or require you to modify or remove any promotion at any time.
15.10 Term, Termination & Changes to the Program
Either party may end your participation in the Program at any time, for any reason, with written notice (including by email). On termination without cause, commissions on accounts you referred before termination continue while those accounts remain active, subject to these Terms. On termination for cause — including fraud, abuse, or violation of these Terms or applicable law — we may cease all future commissions and forfeit any unpaid commissions. We may modify or discontinue the Program, the commission rate, Service pricing, and these Terms at any time; changes apply prospectively, and your continued participation after a change takes effect constitutes acceptance.
15.11 No Earnings Guarantee
The income examples provided in our Program materials are for illustrative purposes only and do not constitute a guarantee of earnings. Actual results may vary based on individual effort, referral quality, market conditions, and client retention. Earnings are not guaranteed and depend on the continued activity of referred clients. Commissions are paid every 30 days only on accounts that remain active and past the money-back guarantee period. This is not a business opportunity or franchise offering. Complies with California Business and Professions Code §§ 17500–17509.
15.12 Confidentiality, Indemnification & General
Non-public information we share with you about the Program, pricing strategy, or other Partners is confidential and may not be disclosed or used except to promote the Services. You agree to indemnify and hold Battle Plan Marketing harmless from any claim, loss, or liability arising out of your promotional methods, your representations, or your breach of these Terms or applicable law. Your participation in the Program is also subject to the disclaimers and limitation of liability in Section 11 and the governing-law provisions in Section 12.
